Manufacturers and Producers Responsibility

Currently, many solar power plants are developed in the Netherlands. Sometimes the operating companies purchase their equipment directly from a foreign manufacturer. In this case the foreign manufacturer sells the products in a 'direct sale to a Dutch end user'. The manufacturer is then assigned the Producer Responsibility.

2 ways to fulfill the Producer Responsibility

According to the Dutch law, non-Dutch manufacturers can fulfil this Producer Responsibility in two ways. The first is to open a Dutch subsidiary and to sell all the equipment to these solar parks through that subsidiairy. The subsidiairy can then arrange compliance. For example, it arranges this by becoming a participant of The ZRN foundation.

The second method is to sell from the home country. In this case, the manufacturer should assign an 'Authorized Representative' based in the Netherlands. This Authorised Representative legally takes over the Producer Responsibility from the manufacturer during the period they are assigned. The SAR foundation is such an Authorised Representative. After taking over the responsibility, they ensure compliance by becoming a member of ZRN.
